How Much Is My Personal Injury Case Worth?

Every Case Is Different

One of the most common questions we hear is “how much is my case worth?” The honest answer is: it depends. No two cases are the same, and the value of your claim depends on a combination of factors unique to your situation.

The Three Pillars of Case Value

At Johnson Injury Law, we evaluate every case based on what we call the Trifecta: injury, fault, and insurance.

1. Injury (Damages)

The severity and nature of your injuries are the biggest factor in determining case value. This includes:

  • Medical bills — past and future treatment costs
  • Lost wages — time missed from work, reduced earning capacity
  • Pain and suffering — physical pain, emotional distress, loss of enjoyment of life
  • Permanent impairment — lasting disability, scarring, or disfigurement

More severe injuries with longer recovery times generally result in higher case values.

2. Fault (Liability)

How clearly the other party is at fault matters significantly. A case where the other driver ran a red light and hit you is stronger than a case with disputed liability. California is a comparative negligence state, meaning your compensation can be reduced by your percentage of fault.

3. Insurance (Coverage)

Even if you have catastrophic injuries and clear liability, the available insurance coverage sets a practical ceiling on recovery. We investigate all potential sources of coverage, including the at-fault party’s policy, your own underinsured motorist coverage, and any umbrella policies.

The Multiplier Effect

For many personal injury cases, attorneys use a multiplier to calculate non-economic damages (pain and suffering). Your total medical bills are multiplied by a factor (typically 1.5 to 5) based on the severity of your injuries, the length of treatment, and the impact on your daily life.
